HAVISUN Technologies Inc. (“HAVISUN”, “we”, “us” or “our”) provides custom software development, systems architecture, IT consulting, and IT staffing and augmentation services to businesses. This Privacy Policy explains how we collect, use, disclose and protect personal information when you visit www.havisun.com (the “Site”) or contact us through it.
We serve clients worldwide, and we aim to handle personal information in line with the privacy laws that apply to us, including Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and, where they apply, other national and regional privacy laws.
1. Who is responsible for your information
HAVISUN Technologies Inc. is responsible for personal information collected through the Site. You can reach us about any privacy matter at info@havisun.com. We will direct your request to the person responsible for privacy at HAVISUN.
2. Information we collect
Information you give us
When you use the contact form or email us, we collect the details you choose to provide, such as your name, email address, company name and the content of your message. Please do not include sensitive personal information (for example, government identifiers, financial account numbers or health information) or confidential business secrets in your message.
Information collected automatically
Like most websites, our web host and related infrastructure may automatically record technical information such as IP address, browser type, device type, pages requested, and date and time of access. We use this for security, troubleshooting and keeping the Site reliable.
Candidate and professional information
If you send us a resume or professional profile, or if we receive your details from a client, a referral, a recruiter or a professional networking platform in connection with potential engagements, we may collect your contact details, work history, skills, education, certifications, availability, compensation or rate expectations, and references you ask us to contact. We collect only what is relevant to evaluating or placing you, and we ask for your consent before sharing your profile with a client.
Cookies and similar technologies
The Site does not currently use cookies or similar technologies for advertising, cross-site tracking or analytics. If we add analytics or other non-essential cookies in future, we will update this Policy and, where required, ask for your consent first.
3. How we use personal information
We use personal information to:
- respond to your enquiries and arrange consultations;
- prepare proposals and provide, manage and improve our services;
- assess skills and availability, match professionals to client opportunities and, with your consent, introduce you to prospective clients;
- communicate with you about our relationship, including administrative messages;
- protect the Site and our business, prevent fraud and abuse, and keep records;
- comply with legal obligations and enforce our rights.
We do not send unsolicited marketing email. If we send you commercial electronic messages, we will do so only with consent or as otherwise permitted by law (including Canada’s Anti-Spam Legislation), and every such message will include a way to unsubscribe.
4. Consent and legal basis
Where the law requires consent, we collect, use and disclose your personal information with your consent. By submitting the contact form or emailing us, you consent to our handling your information for the purposes described in this Policy. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us. Withdrawing consent may mean we can no longer respond to you or provide certain services.
In some cases we may rely on other lawful grounds that applicable law allows, such as performing a contract with you or your organization, our legitimate business interests, or complying with the law.
5. When we share information
We do not sell your personal information and we do not share it for cross-context behavioural advertising. We disclose it only as follows:
- Service providers that help us run the Site and our business, such as web hosting, email, form-handling, and IT and security providers. They may use personal information only to provide services to us and are expected to protect it.
- Prospective and current clients, with your consent, when we put you forward for an engagement.
- Professional advisers such as lawyers, accountants and insurers, where needed.
- Legal and safety reasons, where required by law, court order or a lawful request from authorities, or to protect the rights, property or safety of HAVISUN, our clients or others.
- Business transfers, if HAVISUN is involved in a merger, acquisition, financing or sale of assets, subject to appropriate confidentiality protections.
6. International transfers
We serve clients worldwide, and our service providers may be located in, or access information from, countries other than your own. As a result, your information may be stored or processed outside your province, state or country, where it may be subject to the laws of that jurisdiction and accessible to its courts and authorities. Where we transfer personal information, we take reasonable steps, including contractual measures, to protect it.
7. How long we keep information
We keep personal information only as long as needed for the purposes above. Enquiries that do not lead to an engagement are generally kept for up to 24 months after our last contact, candidate and professional profile information is generally kept for up to 24 months after our last contact unless you ask us to delete it sooner or you are engaged through us, and information related to client engagements is kept for the period needed to deliver the services and meet legal, tax, accounting and contractual requirements. When information is no longer needed, we delete it or de-identify it.
8. Security
We use reasonable administrative, technical and organizational safeguards appropriate to the sensitivity of the information, including access controls and encrypted connections (HTTPS) on the Site. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach creates a real risk of significant harm, we will notify affected individuals and regulators as required by law.
9. Your rights and choices
Depending on where you live, you may have the right to:
- ask whether we hold personal information about you and request access to it;
- ask us to correct inaccurate or incomplete information;
- ask us to delete your information, or withdraw consent, subject to legal exceptions;
- object to or ask us to limit certain uses, and challenge our compliance with this Policy;
- receive a copy of your information in a portable format, where the law gives you that right;
- not be treated unfairly for exercising your privacy rights.
The rights available to you depend on where you live. To exercise a right, email info@havisun.com. We may need to verify your identity first and will respond within the time required by applicable law. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada or the privacy or data protection authority in your own region.
10. Visitors from the EU, UK and other regions
If you are in the European Economic Area or the United Kingdom, we process your personal information on one of these legal bases: to respond to your request or take steps at your request before entering a contract; our legitimate interests in running and securing our business and communicating with prospective clients (balanced against your rights); your consent, where we ask for it; or compliance with legal obligations.
You have the rights described above, as well as the right to restrict or object to processing and to lodge a complaint with your local supervisory authority. When your information is transferred outside your region, we use appropriate safeguards where required, such as contractual protections. To make a request, email info@havisun.com.
11. Children
The Site and our services are intended for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided information to us, please contact us and we will delete it.
12. Third-party links
The Site may link to third-party websites or services (for example, social media). We do not control and are not responsible for their privacy practices, so please review their policies.
13. Changes to this Policy
We may update this Policy from time to time. The “Last updated” date at the top shows when it last changed. For material changes we will post a prominent notice on the Site or, where required, seek your consent again.
